JUSTICE RENDUE

Introduction.

L'administration moderne de la justice ne correspond pas à la civilisation de l'Israël primitif. Les récits des missionnaires aideront à comprendre le genre de ces jugements où le vieillard ou le chef exprime son avis après avoir patiemment écouté les « palabres » des deux parties ; sur quoi plaignants ou tribu se chargent de mettre à exécution la sentence. Notre Moyen âge, empêtré de superstitions et de théologie simpliste, donnera également une idée de cette « justice » tout imprégnée de la peur de Dieu (bien différente de la « crainte de Dieu »). Comme à ces époques lointaines, le prêtre, agent officiel de la divinité ici-bas, prétendra être seul qualifié pour rendre des arrêts dignes d'elle. Ce pouvoir se heurtera ou s'arrangera avec deux autorités rivales : celle du père de famille, qui tend à décroître ; celle du roi, qui s'affirme de plus en plus, si le pouvoir royal est fort. Chez nous, les conflits entre rois, parlements, tribunaux ecclésiastiques, sont un exemple de cette rivalité universelle. Voir Gouvernement ; Crimes, délits et peines.

Époque nomade.

Plus on remonte haut dans l'histoire d'Israël, mieux on voit s'affirmer l'autorité du père de famille. Elle n'est pas proprement judiciaire. Elle est tout simplement autoritaire, puisque le père est le maître absolu et le propriétaire indiscuté de ses gens comme de ses biens. L'histoire d'Abraham est typique à cet égard (Ge 21:14 22:10). De même Isaac bénissant Jacob (Ge 27:37, cf. Laban : Ge 29:19). Tamar est condamnée à mort par son père, à la simple nouvelle de son déshonneur (Ge 38:24), comme on tue une bête malfaisante. D'ailleurs la famille entière est responsable de l'affront fait à l'un de ses membres ; ce sont les frères de Dina qui se chargent de la venger (Ge 34:7,13-25). Comp, le « vengeur du sang » (voir art.) dans De 19:6,12. L'histoire des familles italiennes au XIV° siècle et des « vendette » corses nous donne une idée de ce stade de la justice.

Il va de soi qu'à cette époque l'idée de justice était à peine dégagée d'autres notions similaires. L'injustice était considérée comme une offense à Jéhovah, ce qui est normal, mais pouvait se confondre aussi avec sa volonté (Ge 20:3), tant que morale et religion n'étaient pas nettement unies.

Le clan.

Lorsque les familles s'unirent pour se constituer en clans, l'autorité judiciaire passa à un groupe d'anciens (No 11:16). De tels usages sont courants dans les familles agricoles. Nous avons rencontré, dans un département du Midi de la France, un père de famille breton qui était devenu l'arbitre écouté des autres cultivateurs bretons établis dans son voisinage. Cette justice entre semblables est infiniment plus souple et plus efficace que l'officielle.

Moïse.

La notion de loi (divine) a toujours été rattachée à la personne de Moïse. Quelque bref qu'ait pu être le Décalogue primitif, on ne voit aucune raison de contester que ce grand chef ait pu donner un code substantiel et fondamental au troupeau qu'il avait converti en nation. Le récit de Ex 18:13 et suivants fait allusion à quelque crise d'autorité que nous discernons mal. Il est sûr qu'avant ce moment les chefs de famille avaient déjà à régler mille conflits immédiats. Il ne peut être question ici que d'une extension de ce système traditionnel, sur le conseil de Jéthro d'après notre récit.

Le Jugement de Dieu.

On ne sait au juste comment fonctionnait cette institution théocratique (Ex 22:8 et suivant). Dans Jos 7:16 et suivants, il est fait mention d'une sorte de tirage au sort par un procédé sacré. (cf. 1Sa 14:41 et suivants, où Dieu désigne par le sort celui qui a désobéi à l'ordre formel du roi Saül) Une fois la condamnation prononcée, l'exécution appartenait aux plus convaincus, aux fidèles (Ex 32:26), plus tard aux témoins accusateurs (De 17:7).

Époque sédentaire.

L'établissement des Israélites en Canaan ne modifia pas profondément le système judiciaire. On trouve mentionnés les « anciens de la ville ». C'est à eux que le père peut remettre son fils indocile (De 21:18 et suivants). Les anciens figurent déjà dans Jug 8:16. Mais les personnages de cette époque appelés improprement juges (voir Juges, livre des) étaient de petits souverains temporaires et non pas spécialement des magistrats. Le lieu où se rend la justice est la porte de la ville, seul espace assez vaste pour contenir une foule, car les débats sont publics. Absalom voulant se substituer à David, son père, dans l'exercice du pouvoir, interpellait les plaignants près de la porte (2Sa 15:2). Plus tard Salomon, qui aimait le luxe, instaura un Porche du jugement, attenant à son palais (1Ro 7:7).

La royauté.

Avec la royauté, la justice entre dans une phase toute nouvelle, et cela pour deux raisons :

Le roi se réserve les causes graves (2Sa 14:10 15:2,1Ro 3:16 2Ro 15:5). D'ailleurs, lorsque les Israélites demandaient un roi, c'était pour être jugés et conduits dans les guerres (1Sa 8:20).

Le roi établit dans certaines villes des juges professionnels, des officiers royaux, analogues à nos « baillis » royaux (De 16:18). Il est probable que de cette époque (IX e siècle av. J. -C.) date le petit code inséré dans Ex 21-23:9, fort incomplet d'ailleurs et peut-être destiné à guider ces nouveaux fonctionnaires. Ce code est le seul qui nous soit connu entre la conquête et le Deutéronome. On ignore jusqu'à quel point il fut en usage dans tout Israël. Il était sans doute conforme à l'enseignement donné dans les grands centres, tels que Jérusalem, Béthel, Samarie. Il va de soi que ce code ne prétend pas innover, mais entend résumer les usages judiciaires existants. Les accusations des premiers prophètes : Amos, Osée, Ésaïe, Michée, contre ceux qui violent sciemment la justice, supposent l'existence d'un tel code. Au VII e siècle apparaît un code autrement important : le Deutéronome, qui se réclame de Moïse, mais reflète la mentalité des prophètes. S'il fut proclamé en 621 (2Ro 22), il s'effondra bientôt avec Josias, ce roi mystérieusement victime des pharaons, et ne trouva toute son autorité qu'après l'exil. Il prévoit des juges et des fonctionnaires dans toutes les villes (De 16:18). Les juges ordinaires sont toujours les « anciens de la ville » (De 19:12 21:19 22:15 et suivants). La malédiction de Dieu est encore le châtiment suprême (De 28:15 et suivants).

Un nouvel instrument judiciaire y apparaît, le prêtre ou lévite, qui dans certains cas s'associe aux « anciens » (De 17:9 et suivants 19:17 21:5 24:8).

Si le Deutéronome est un magnifique manifeste de l'esprit prophétique : droiture et fidélité, il dévoile une plaie de ce temps, déjà dénoncée dans le Décalogue (Ex 20:16), savoir le faux témoignage (De 19:16 et suivant) ; il interdit au juge de se laisser corrompre par des présents (De 16:19, cf. Ex 23:8,2Ch 19:7). Les prophètes s'élèvent contre la vénalité des juges (Am 2:3 5:12, Mic 3:11 7:3, Sop 3:3, Esa 12:3 5:7,20,23, Eze 22:12) ; Esa 11:3-5 donne le portrait du vrai juge. Le cas d'Achab et Jézabel a fait scandale en révélant un état de décomposition sociale (1Ro 21). Il ne faut pas oublier toutefois que les « anciens » des villes continuaient à juger tous les cas ordinaires.

Deux textes font mention de la création de juges : 1Ch 23:4 et 2Ch 19:5 et suivants. Le premier veut que 6.000 Lévites eussent été créés par David « magistrats et juges » (Sg.), hyperbole et anachronisme évidents. Le second raconte que Josaphat établit des juges dans toutes les villes fortes du pays de Juda, ce qui peut faire allusion à une nouvelle organisation de la justice, un siècle après David.

L'exil eut cet effet inattendu, mais bien compréhensible, de donner une autorité immense à cette Loi qui avait été si peu ou si difficilement appliquée du temps de l'indépendance, et qui devenait lettre morte sous une domination étrangère. De cette époque date l'étude minutieuse de la Loi (voir ce mot).

Au retour de l'exil se constitua dans le territoire retrouvé une communauté religieuse plutôt qu'une puissance politique. Le Pentateuque fut son code ; il fut solennellement lu et proclamé (Ne 8-10). La justice locale est toujours rendue par les « anciens » (Esd 7:25 10:14) ; il y en a sept dans les petites villes, trente-trois dans les grandes. Durant la domination perse, le gouverneur perse était naturellement le juge suprême ; mais pour toutes les affaires religieuses, il laissait pleins pouvoirs au grand-prêtre et à ses conseillers. C'est à cette époque que l'autorité des prêtres s'accrut considérablement. Au début de la domination grecque, qui suivit, leur puissance était établie. Il est probable que nous avons là l'origine du Sanhédrin (voir ce mot), cour suprême située à Jérusalem. Il juge les causes dépassant la capacité des cours locales, où la procédure était la suivante : le plaignant portait ses doléances devant la cour, dûment avertie, et en public ; après quoi l'autre partie présentait sa défense (Job 31:35, « une défense toute signée » implique un acte écrit, destiné sans doute à la lecture publique). D'après De 17:6 19:15, renforcé par le Talmud, le témoignage de deux personnes, de préférence trois, hommes et adultes, était nécessaire pour valider une accusation. Le témoignage d'un esclave était sans valeur. Avant de déposer, les témoins devaient jurer de dire la vérité et toute la vérité. Les faux témoins étaient condamnés à subir la peine qui eût été infligée à la victime de leurs machinations, comme le précise De 19:19. A défaut de témoins, il appartenait aux juges de dégager la vérité par leurs questions et leur bon sens. L'accusateur se tenait à la droite de l'accusé. Ce dernier, en tout cas après l'exil, était en costume de deuil (Za 3:1 et suivants). A la fin de la période des Macchabées, et sous la domination romaine, les Pharisiens gagnent de l'influence et forment un parti important dans le Sanhédrin, sans détrôner toutefois le parti Sadducéen (les prêtres, parmi lesquels on choisissait le grand-prêtre). Nouveau Testament.

Deux cas donnent un intérêt extrême à la question de la justice au I er siècle :

LE PROCES DE JESUS.

Les Juifs, et surtout le Sanhédrin, voulaient la mort de Jésus. Or les Romains leur avaient retiré le droit de prononcer la peine capitale ; d'après le Talmud, ils perdirent ce droit quarante ans avant la chute de Jérusalem, ainsi fort peu de temps avant le procès de Jésus. Il leur fallait donc faire condamner Jésus par le gouverneur romain, Pilate. Ce dernier devait évidemment rester insensible à leurs griefs véritables qui étaient, pour les Pharisiens, le ressentiment de voir leurs traditions attaquées ; pour les Sadducéens, la crainte de voir saper leur autorité branlante. Le motif officiel mis en avant par le Sanhédrin fut le blasphème contre Dieu. Ce chef d'accusation religieux et proprement juif ne pouvant non plus affecter un gouverneur romain, ils accusèrent Jésus de vouloir supplanter César (Lu 23:2, Jn 19:15), ce qui finalement arracha au lâche gouverneur, par peur de se compromettre, la condamnation à mort, sous la forme romaine : la crucifixion (et non la lapidation, qui eût été la forme juive). L'ARRESTATION DE PAUL.

L'apôtre étant citoyen romain, sa position diffère totalement de celle d'un Juif quelconque. Le magistrat fixe à sa guise l'époque du procès, et maintient l'accusé en prison jusqu'à cette date. Il peut lui infliger trois modes de captivité :

(a) l'enchaîner dans une prison (Ac 12:6 21:33) ;

(b) lui adjoindre un soldat, auquel il est lié par une chaîne et qui répond de lui ;

(c) le laisser libre sous la surveillance et la responsabilité d'un magistrat, ce qu'on n'accordait qu'aux personnages de rang. Paul connut le second système.

Tout citoyen romain pouvait arrêter le cours de son procès en faisant appel à l'empereur. Il prononçait : Coeswrem appello (Ac 25:11 et suivant). Dès lors on le déférait à l'empereur à Rome, sous bonne escorte, soit en profitant de la relève d'une garnison lointaine, soit en le joignant à d'autres prisonniers, qu'on embarquait souvent sur les navires impériaux ravitaillant l'Italie en blé d'Egypte, pendant la saison de la navigation (avril-octobre), ou bien qu'on envoyait par les routes impériales, militairement gardées et pourvues de gîtes d'étapes.

      4 If the stolen property is found in his hand alive, whether it is ox, donkey, or sheep, he shall pay double.

      9 For every matter of trespass, whether it be for ox, for donkey, for sheep, for clothing, or for any kind of lost thing, about which one says, 'This is mine,' the cause of both parties shall come before God. He whom God condemns shall pay double to his neighbor.
      10 "If a man delivers to his neighbor a donkey, an ox, a sheep, or any animal to keep, and it dies or is injured, or driven away, no man seeing it;
      11 the oath of Yahweh shall be between them both, whether he hasn't put his hand to his neighbor's goods; and its owner shall accept it, and he shall not make restitution.
      12 But if it is stolen from him, he shall make restitution to its owner.
      13 If it is torn in pieces, let him bring it for evidence. He shall not make good that which was torn.
      14 "If a man borrows anything of his neighbor's, and it is injured, or dies, its owner not being with it, he shall surely make restitution.
      15 If its owner is with it, he shall not make it good. If it is a leased thing, it came for its lease.
      16 "If a man entices a virgin who isn't pledged to be married, and lies with her, he shall surely pay a dowry for her to be his wife.
      17 If her father utterly refuses to give her to him, he shall pay money according to the dowry of virgins.
      18 "You shall not allow a sorceress to live.
      19 "Whoever has sex with an animal shall surely be put to death.
      20 "He who sacrifices to any god, except to Yahweh only, shall be utterly destroyed.

      23 If you take advantage of them at all, and they cry at all to me, I will surely hear their cry;

      26 If you take your neighbor's garment as collateral, you shall restore it to him before the sun goes down,
