C'est un conseil suprême, qualifié pour fixer la jurisprudence dans des cas douteux, et auquel s'adressent, non les parties, mais le tribunal inférieur lui-même, pour réclamer une direction. On pourrait cependant expliquer cette forme en l'appliquant à la distinction à faire entre les différentes espèces de meurtres (Exode 21.13) et de blessures. Dans les trois expressions : meurtre, contestation et blessure, on retrouve les trois domaines criminel, civil et correctionnel.Sujets de désaccord. Cette expression n'est pas une apposition des trois termes précédents ; elle exprime plutôt l'idée du désaccord qui s'est produit, au sujet de quelqu'un des cas indiqués, dans le sein du tribunal local : dans tes portes.Tu monteras. C'est un conseil suprême, qualifié pour fixer la jurisprudence dans des cas douteux, et auquel s'adressent, non les parties, mais le tribunal inférieur lui-même, pour réclamer une direction. C'est ainsi que déjà au désert ces causes là étaient soumises à Moïse (Exode 28.22), à Moïse et Aaron (Nombres 15.33), et plus tard à Moïse et Eléazar (Nombres 27.2) ; de même qu'Aaron représentait alors le sacerdoce siégeant à côté de Moïse le juge, de même le tribunal supérieur à établir devra se composer de sacrificateurs auxquels seront adjoints les hommes qui seront établis comme juges du peuple entier (verset 9).Un cas de meurtre... Nous rendons ainsi l'expression hébraïque obscure : entre meurtre et meurtre..., entre blessure et blessure. On pourrait cependant expliquer cette forme en l'appliquant à la distinction à faire entre les différentes espèces de meurtres (Exode 21.13) et de blessures. Dans les trois expressions : meurtre, contestation et blessure, on retrouve les trois domaines criminel, civil et correctionnel.Sujets de désaccord. Cette expression n'est pas une apposition des trois termes précédents ; elle exprime plutôt l'idée du désaccord qui s'est produit, au sujet de quelqu'un des cas indiqués, dans le sein du tribunal local : dans tes portes.Tu monteras. D'après le Talmud, les membres du tribunal inférieur s'adressaient d'abord à un tribunal siégeant à la porte du temple ; si celui-ci ne pouvait donner de réponse, ils allaient à un second, d'ordre plus élevé, siégeant à la porte du parvis ; et si celui-ci déclarait à son tour son insuffisance, ils arrivaient au tribunal suprême, siégeant dans la fameuse salle en pierres de taille (Lischekath haggazzith), dans le parvis même ; cette cour suprême était présidée par le souverain sacrificateur. Josèphe (Antiquités Judaïques, IV.8.14) paraphrase ainsi la parole de Moïse :Si les juges inférieurs ne savent pas prononcer, qu'ils portent la cause intacte à la ville sainte, et le grand sacrificateur, le prophète et le Conseil se réunissant, prononceront ce qui leur paraîtra juste. C'est un conseil suprême, qualifié pour fixer la jurisprudence dans des cas douteux, et auquel s'adressent, non les parties, mais le tribunal inférieur lui-même, pour réclamer une direction. C'est un conseil suprême, qualifié pour fixer la jurisprudence dans des cas douteux, et auquel s'adressent, non les parties, mais le tribunal inférieur lui-même, pour réclamer une direction. C'est ainsi que déjà au désert ces causes là étaient soumises à Moïse (Exode 28.22), à Moïse et Aaron (Nombres 15.33), et plus tard à Moïse et Eléazar (Nombres 27.2) ; de même qu'Aaron représentait alors le sacerdoce siégeant à côté de Moïse le juge, de même le tribunal supérieur à établir devra se composer de sacrificateurs auxquels seront adjoints les hommes qui seront établis comme juges du peuple entier (verset 9).Un cas de meurtre... Nous rendons ainsi l'expression hébraïque obscure : entre meurtre et meurtre..., entre blessure et blessure. On pourrait cependant expliquer cette forme en l'appliquant à la distinction à faire entre les différentes espèces de meurtres (Exode 21.13) et de blessures. Dans les trois expressions : meurtre, contestation et blessure, on retrouve les trois domaines criminel, civil et correctionnel.Sujets de désaccord. Cette expression n'est pas une apposition des trois termes précédents ; elle exprime plutôt l'idée du désaccord qui s'est produit, au sujet de quelqu'un des cas indiqués, dans le sein du tribunal local : dans tes portes.Tu monteras.
