16.18-18.22. La sainteté de la vie du peuple telle qu'elle devra être maintenue par les autorités qui le gouverneront à la suite du départ de Moïse et de la conquête.

16.18-17.13 Les autorités judiciaires.

Déjà au commencement du séjour dans le désert, Moïse, d'après le conseil de Jéthro (Exode 18.1-27 ; Deutéronome 1.9-18), avait établi sur le peuple des hommes chargés de rendre la justice. Maintenant que le peuple va commencer à mener une vie sédentaire et se disperser dans tout le pays, une organisation judiciaire plus complète, avec un tribunal supérieur pour trancher les questions de droit les plus difficiles, devient nécessaire. Des magistrats devront être établis dans toutes les villes de la Terre Sainte. On a rapproché cette ordonnance de l'organisation judiciaire attribuée à Josaphat (2Chroniques 19.5 et suivants) et supposé que l'auteur du Deutéronome n'avait fait autre chose qu'antidater cette institution en l'attribuant à Moïse lui-même. Mais le peuple, qui n'avait pu se passer d'une institution judiciaire au désert, ne peut en être resté privé en Canaan jusqu'au temps des Rois. Josaphat, dans toutes ses réformes religieuses et civiles, ne paraît pas avoir innové (2Chroniques 17.3). Il a rétabli et régularisé. Il n'y a rien que de naturel à ce que, dans la prévision du prochain établissement du peuple en Canaan, Moïse ait pourvu à une administration de la justice plus complète que celle qui avait été établie provisoirement à Sinaï.

Tu établiras. Il semble que ce soit le peuple qui doive nommer lui-même ses magistrats.

Greffiers. Le terme hébreu est le même que celui qui a été traduit par contre-maîtres dans Exode 5.6,14 et par hommes d'office dans Nombres 11.16.

Selon tes tribus. Même mode d'élection que 1.13.

Dans ce texte, un soin particulier est pris, en ce qui concerne la justice. Toute considération personnelle devait être bannie de ce contexte, afin que tous puissent être jugés équitablement, sans porter atteinte à qui que ce soit. Il était expressément recommandé aux Hébreux de ne fabriquer ni idoles, ni statues païennes. Rien ne pouvait, en effet, éloigner davantage l'Éternel du peuple, ni corrompre l'esprit de la nation d'Israël, que la représentation d'images idolâtres.

Dieu est Tout Puissant, omniprésent et possède un Esprit Éternel ; hélas, encore aujourd'hui, au temps de l'évangile, où nous sommes sous une meilleure dispensation, il y a toujours cette tendance dans le cœur de l'homme, à se tourner vers les idoles, quel que soit leur aspect.
