Que son cœur ne s'élève pas. Ce qui distingue le roi d'Israël des despotes de l'Orient, c'est qu'au-dessus de sa volonté et de ses caprices, il y a une loi supérieure qui est la même pour le moindre Israélite que pour lui (ses frères).

Lui et ses fils. Ces mots établissent l'hérédité comme règle, mais sans exclure un changement de dynastie en cas d'infidélité, comme cela a eu lieu par la substitution de la famille de David à celle de Saül.

Appendice sur le passage relatif à la royauté

Nous croyons avoir montré que Moïse a pu et dû se préoccuper déjà lui-même non seulement de la question de la royauté à établir un jour en Israël, mais aussi des dangers auxquels serait exposée cette institution. Lors même que ces dangers se sont réalisés au plus haut point dans le règne de Salomon, il n'est nul besoin de faire intervenir ce règne pour expliquer les termes employés dans notre passage, puisque la manière de vivre ici défendue était et est encore celle de tous les monarques orientaux. Mais on s'est demandé si l'existence de ce passage est compatible avec le refus qu'opposa Gédéon à ceux qui l'invitaient à se faire roi (Juges 8.22 et suivants), puis dans quelle relation a pu être avec cette prescription du Deutéronome ce droit de la royauté qu'écrivit, Samuel après que le sort eut désigné Saül comme roi. La réponse de Gédéon indique clairement sa pensée. Il croyait devoir s'en tenir pour lui-même au point de vue théocratique normal, tel que nous l'avons exposé plus haut, d'après lequel Dieu est l'unique roi de son peuple. Par l'expérience personnelle qu'il avait faite de la grandeur et de l'assistance de ce pouvoir suprême, il avait pu comprendre ce vrai point de vue mieux que ne le faisait la masse de ses compatriotes.

Le droit de la royauté rédigé par Samuel a été identifié par plusieurs avec notre passage lui-même, soit qu'on ait supposé que ce document avait été inséré ensuite dans le Deutéronome, soit que l'on ait admis que Samuel n'avait fait que tirer lui-même copie de notre passage en l'intitulant le droit de la royauté. Mais si dans ce passage certaines défenses sont faites au roi, suivies de certaines recommandations morales, il n'est pourtant nullement question des relations officielles entre le peuple et le roi et de leurs obligations respectives ; et c'est plutôt là ce que l'on s'attend à trouver dans un document intitulé droit de la royauté. Il nous paraît donc qu'il s'agit d'un document différent, dans lequel Samuel chercha à régler en traits généraux les rapports entre Israël et son roi.

On s'est encore demandé comment, si une loi, comme celle du Deutéronome, existait au temps de Salomon, le souverain a pu la violer si ouvertement et sans qu'aucun prophète la lui ait rappelée. Mais il serait faux de croire qu'il n'ait pas été repris, et le sévère avertissement 1Rois 11.11 doit sans doute être placé dans la bouche d'un prophète. Comparez encore versets 30 et suivants.
