2 à 11 Premier groupe

Ce premier titre est consacré au droit des serviteurs. Le grand Décalogue n'indiquait que les devoirs envers les supérieurs et les égaux ; peut-être est-ce là la raison pour laquelle le code destiné à le compléter commence par le droit des inférieurs. Ce groupe se compose de deux moitiés égales, comme le Décalogue proprement dit. La première (versets 2 à 6) concerne les esclaves en général ; la seconde (versets 7 à 11) traite d'un cas particulier relatif aux esclaves femmes.

Les Israélites avaient de vrais esclaves, de race étrangère (Lévitique 25.44-46), mais aussi des serviteurs israélites dont l'asservissement n'était que temporaire. Un Israélite pouvait devenir esclave, soit par condamnation judiciaire, parce qu'ayant volé il n'avait pas de quoi restituer (Exode 22.3), soit spontanément, contraint à cela par la pauvreté (Lévitique 25.39). En réalité, ce servage n'était qu'un engagement pour six ans, comme on le voit dans ce verset. Voir les développements philanthropiques que donne sur ce point le Deutéronome chapitre 15.

D'après Lévitique 25.39 et suivants, le servage des Israélites devait se terminer à l'année du Jubilé et pouvait, par conséquent, durer quarante-huit ou quarante-neuf ans. Cette prescription ne paraît pas d'accord avec celle contenue dans notre verset. Mais elle s'appliquait sans doute aux esclaves qui avaient refusé de recouvrer leur liberté après la sixième année (versets 5 et 6).
